Summary

In Assam, 28 hectares of forest land in Sivasagar district’s Geleky Forest Reserve at the Assam-Nagaland border has been diverted for the construction of second Assam Commando Battalion Camp.

The National Green Tribunal (NGT) has sent notices to various authorities, including the Assam government, the Assam Forest Department, the Union Ministry of Environment, Forest, and Climate Change (MoEFCC), the District Commissioner of Sivasagar, and the Divisional Forest Officer in response to a petition filed by environmental activist Rohit Choudhury. The petitioner claimed that MK Yadava, the former Principal Chief Conservator of Forests and Head of Forest Force in Assam, unlawfully redirected 28 hectares of forest land for construction of second Assam Commando Battalion Camp in the Geleky Forest Reserve.
 
The plea stated that Yadava, now the Special Chief Secretary (Forests) for Assam, misused “his power and position to illegally divert a large part of the forest area without fulfilling the requirements of Compensatory Afforestation and Net Present Value, which makes him personally liable for compensating and restoring the damage done to the forest.”
 
As per the petition, the diversion violates the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980 and the latest guidelines of the Central Government dated 29 December, 2023. According to the Forest (Conservation) Law, 1980, diversion of forest land for activities unrelated to forestry must receive prior approval from the MoEFCC.
 
In an order dated 29 May 2024, the NGT ordered the formation of a committee to investigate these claims, highlighting that the issue involves significant environmental concerns and potential violations of the Forest (Conservation) Act, 1980. The committee includes the Additional Director General of Forests from the MoEFCC, an Additional Secretary nominated by the MoEFCC Secretary, and the Deputy Director General of Forests(C) from the MoEFCC's Integrated Regional Office in Meghalaya.

Meanwhile, the NGT's New Delhi bench is hearing another case of illegal diversion of protected forest land. In January 2024, the NGT bench had taken up a suo-moto case concerning the purported illegal use of 44 hectares of protected forest land for establishing the Assam Police's Commando Battalion near the Assam-Mizoram border in Inner Line Reserve Forest, Hailakandi district. In this case too, Yadava had allegedly approved the construction within a protected forest, reportedly to prevent encroachment by individuals from Mizoram. This decision incited significant concern among local conservationists.
 
Consequently, on 28 March 2024, the Union Ministry of Environment acknowledged that the battalion's construction violated the Forest Conservation Amendment Act. The Assam government subsequently informed the NGT that it had stopped the construction of the commando camp on the 44 hectares in Hailakandi. 

The MoEFCC regional office in Shillong gave a show cause notice to MK Yadava on 14 May 2024. The notice declared him guilty of the offense and gave him 60 days to respond, failing which legal action would be taken.
