Summary

The Naina Devi Himalayan Bird Conservation Reserve, encompassing an area of 111.9 sq km in Nainital district, was notified on 9 March, 2015. This was done with the twin goals of conserving the rich flora and fauna present in the Kosi and Naina forest ranges as well as to increase tourism-related livelihoods in the surrounding villages while curbing the rampant development of resorts in this fragile area.

With time, the popularity of the reserve increased and brought in tourists. This unfortunately also led to the development of tourism-related infrastructure in the area. While any construction within the Bird Conservation Reserve needs the permission of the Forest Department, the widening of a road has led to controversy and conflicts around land use. The road is located in the Naina Devi Bird Reserve at Kilbury, Pangot area of Nainital.

The village of Budhalakot received permission for a pedestrian path through the reserve forest in 2013. However, the land was purchased by a builder named Upendra Jindal who allegedly proceeded to widen the road and make it accessible to motor traffic. 

The Gram Pradhan filed a PIL with the Uttarakhand High Court stating that this road, allegedly done in a collusion between some hotel owners and Forest Department officials, was threatening the fauna in the area. The PIL stated that the builder bought the village land allegedly with the help of Poonam Chand, an officer of the Tourism Department, in 2013 and began building a motorable road, destroying valuable reserve forest area, to make a four-storeyed hotel he owns in Pangot accessible to people. 

The High Court stopped the construction of this motorable road on 12 September 2022. 

Despite this, widening of the road appears to have continued. This prompted the filing of a petition with the National Green Tribunal (NGT) on 13 September 2023, almost exactly a year after the High Court order. The tribunal constituted a committee to look into this matter. However, after considering the report filed by the committee, which stated that forest authorities were present while construction of the 'kaccha' road was ongoing, the Tribunal has disposed of the case.
