Summary

Devunikunta Lake (also known as Humayun Lake) is located in Asif Nagar mandal in Hyderabads Mehdipatnam area. In June 2019, civil rights activists in the city wrote a letter to the Greater Hyderabad Municipal Corporation (GHMC) against encroachment of the lake by the Boghdadi brothers, belonging to a politically influential family in the city. The lake is adjacent to a crematorium and its waters are regularly used by Hindus to perform the last rites of their dead. Picking on this, the issue was politicised when many opposition parties like the Congress, the Telangana Jana Samithi and the Communist Party of India staged a protest at the GHMC headquarters and alleged political patronage of All India MajliseIttehadul Muslimeen in the encroachment. The dispute started in March 2019 when the Boghdadi brothers began levelling and dismantling the lake for some unauthorised construction. When the local people informed the district collector, he ordered the Asif Nagar tehsildar to protect the lake. Following this, the Boghdadi brothers moved the High Court of Telangana, citing the order of the City Civil Court, Hyderabad, according to which the _patta _(land title) of 11 acres and 22 _guntas _of land belonged to their mother, Muneerunnisa Begum. Countering their argument, the GHMC officials said that the lake was a notified tank and also Sikham land, where _patta _(title deed) has been given to the people but no construction activity can be taken up as per the Telangana Water, Land and Trees Act, 2002. After the court ruled in favour of the Boghdadi Brothers, the GHMC officials alleged that the brothers had forged papers to win the case. On September 21, 2019, the Humayun Nagar police registered a case against the Boghdadi brothers under IPC sections 420 (heating), 468 (forgery) and 471 (using a fabricated document as genuine), on the complaint of D. Srinivas Reddy, revenue divisional officer of Hyderabad, for misleading the court. The local tehsildar was also suspended for inaction. Activist Lubna Sarwath told the media that the high court's judgment for peaceful possession of the lake by the Boghdadi brothers was issued without verifying the authenticity of decree in OS 104 of 1992. The judgement that is not in favour of water bodies is in contempt of the Supreme Court's judgement in the Hinch Lal Tiwari vs Kamala Devi and Ors (July 25, 2001) case. The apex court said that the government, including the revenue authorities, had noticed that the pond in that case was being neglected, so they should have developed it. This would have prevented an ecological disaster and also provided better environment for the benefit of the public". In December 2019, Humayunnagar police stated that they will verify the documents keenly and act accordingly owing to the issue's civil nature.
