Summary

On 19 November 2024, 6500 residents of Sai Galaxy Apartments, Dombivli, realised that they have been dispossessed of their homes after the Bombay High Court ordered authorities to demolish 62 illegal buildings in the suburbs, including their apartment complex.

Sandeep Patil, a local activist and an architect, first found that the Sai Galaxy Apartments do not possess an authentic RERA Certificate. On further investigation, it was found that the permissions obtained from KDMC of building certificates and occupational certificates were also fraudulently obtained. Patil then filed a PIL in the Bombay High Court in 2021 asking for a proper investigation of the certification and permissions of building constructed by Sai Builders and Developers. The High Court then ordered an investigation and found significant failures in the regulatory bodies provision of permissions to the builder along with the creation of fraudulent RERA certificates.

These certificates were used by the builder to deceive the buyers of houses in 2019, who bought the houses on loans and EMIs. Furthermore, residents informed that they had also obtained Pradhan Mantri Awas Yojana loans for the purchase of homes in the apartment complex. The residents hoped that the court would understand that they would consider the fraud done to them and provide some relief in form of rehabilitation at an alternative housing or a stay on demolition till the state government provided a rehabilitation option.

However, the court did not agree to the arguments of residents and gave the corporation three months to complete the process of eviction and demolitions. The residents also applied for regularisation of 38 buildings but the permission was denied as it was illegally developed on public  land.

An FIR was filed against the developer and a SIT was formulated to uncover the extent of irregular developments. As of March 2025, 15 persons have been arrested, including some builders and others in the case. Meanwhile, the Municipal Corporation of Kalyan and Dombivali started demolition of buildings in February.

Rohan Gamare, a resident of the Sai Galaxy building in Dombivli, told the Times of India, "In 2019, when this building was under construction, we bought our house after checking the documents. It was the responsibility of the ward officer of that area to stop construction. But KDMC not only failed to declare the construction illegal, but also provided water, electricity and other facilities."

Flat owners in these buildings continue to appeal for state intervention, claiming they were unaware of the scam.
