Summary

At least 44 houses in a Dalit-dominated settlement in Bihar’s Nawada district were torched on 18 September 2024 over an ongoing land dispute. The arson left more than 150 persons homeless.

Locals say that dozens of armed persons attacked the colony at around 7.15 pm when they were busy cooking for dinner. The colony has around 80 huts and majority of the residents are Musahars or Chamars. Both the communities fall under the Scheduled Castes category.

Attackers allegedly opened fire before setting the huts on fire. 

The incident is a fall out of ownership dispute of 16 acres and 86 decimal of land between two groups. A title suit (number 22/1995) has been going on for this land in the munsif court of Nawada since 1995.

Arjun Prasad Singh, the lawyer fighting this case on behalf of the victim families, told LCW, “My clients have been living on this land for at least one generation. The survey done a hundred years ago says that land was non-cultivated fallow land. But, the land was wrongly registered in the name of Ramzan Mian in the 70s. The land was later bought from Ramzan Mian by Nandu Paswan and others.”

Vaishnavi Manjhi, who lost her hut, claimed that she had been living there for years, and the state government also recognises them as they have voter cards at this address. However, DM Ashutosh Kumar Verma said land records over the years have shown the land as both "gair majarua" land and "raiyat" land.

Contrary to the top officials, Nawada Sub-Divisional Magistrate (SDM) Akhilesh Prasad claimed that the colony was established illegally. “The colony is settled on the raiyat land of Shamsul Mian. The colony is settled illegally. The matter is being investigated,” Akhilesh Prasad said.

Nageshwar Paswan, local ward member and son of Nandu Paswan who was arrested in this case, told that land on which the colony is located belongs to them. He said, “We have nothing to do with this arson. We are fighting a court battle to get the land back. We want a peaceful solution, so we have approached the court. While we are waiting for the court’s decision, they themselves have conspired and carried out this incident.”

Arjun Prasad Singh told LCW, “The title suit dragged on for so long due to delay in the court's proceedings. Many plaintiffs of this case died at different times so their legal heirs had to go to court to get the deceased person's names deleted.”  One such application was filed in Patna high court in 2009 to delete names of Plaintiff number 4, 10 and 12. 

On 29 May 2023, the Nawada district court had ordered the inspection of the disputed land. 

Meanwhile, affected families have vowed not to leave the land. “We have been in possession of this land for over 40 years now. Come what may, we will not leave the place,” said 85-year-old Surju Manjhi.

Meanwhile, the Nawada police have registered FIR against 28 persons under sections 191(2), 191(3), 109(1), 109(1), 352, 351(2)(3), 326(G), 303(2), 111(3) and 61(2)(a) of Bhartiya Nyay Sanhita (BNS), section 27 of Arms Act and section 3(1)(f)(g)(r)(s)(w), 3(2)(V-a) and 3(2)(v) of SC/ST Act. The police have also arrested 15 people including the main accused Nandu Paswan. Three country-made pistols, bullets, one pellet and six motorcycles have been seized from the arrested people.
