On 13 February 2024, the Kamrup (Metro) district administration issued eviction notices to 43 families living on the banks of the Bharalu river in the city. However, the Gauhati High Court halted these evictions.
Justice Manish Choudhury granted the stay after reviewing documents showing the families' refugee status, which were included in their writ petition (Case No.: WP(C)/966/2024). The court found that the petitioners had made a strong preliminary case for temporary protection based on these documents.
The 43 petitioners claim to be legal heirs, representatives, or descendants of Indian citizens who immigrated to India from East Pakistan (now Bangladesh) after the 1947 partition. They assert they were granted refugee status and were permitted by the State Government's Revenue Department to reside on the land by the Bharalu River, under Dag No. 815 old.
The petitioners stated that their families have lived on the land since 1951, now designated as Dag No. 1682 [new]. The counsel of the petitioners also brought up an order from the then-Deputy Commissioner Kamrup, dated 19 April 1956, which allowed the refugees or the families of the petitioners to occupy the land until they were granted land elsewhere, under certain conditions.
The High Court instructed officials to hold off on taking any action until further directives are issued.
