Proposed shifting of the Gauhati high court & other courts from its present location to the outskirts of Guwahati
On June 27, 2023, lawyers of the Gauhati High Court Bar Association (GHCBA) staged sit-in protests opposing the proposed plan of relocating the Gauhati High Court to the Rangmahal area in the Kamrup (Rural) district of Assam.
Previously known as the High Court of Assam, Gauhati High Court was established in 1948 and the old court building was set up in 1960.
The Government plans to construct a judicial city in Assam's Amingaon where the court will be shifted to. Located in Kamrup (rural) district, the proposed location lies on the northern bank of river Bhramaputra. Amingaon city is almost 30 km away from the present courthouse.
The Gauhati high court bar association (GHCBA) submitted a memorandum to the President of India, the Chief Justice of India, the Union Law Minister, the Governor and the Chief Minister of Assam, expressing their dissent on the Government's decision to shift the present High Court.
The lawyers assert that the shifting of the court complex to a remote location would have a negative impact on their productivity as they will have to spend a longer time on commute.
While addressing the media, one of the protesting lawyers said, "There was no demand from the lawyers or the public at large that we've got difficulty in the present set-up of courts. The justification given by the government for the expansion of the courts citing that there isn't sufficient space for the people here is not true. We are suspecting that the decision may not be in the public interest but for personal gain. We believe there are vested interests involved here_._"
Chief Minister Himanta Biswa Sarma announced the release of a draft of the relocation plan on April 14, 2023. A high-level committee was formed on May 23, 2023, to examine the proposed site measuring 240 bighas, out of which 100 bighas were meant to be entitled to the Gauhati High Court, other judicial courts of the Kamrup area, and residential accommodation for judges and staff.
GHCBA's representation stated, "The place where the proposed judicial city is to come up is yet to have any kind of infrastructure, and at present, it can be reached from Guwahati by traveling over the Saraighat Bridge, which takes about 30 km of travel, or by Ferry Service. However, a new bridge is being constructed over the river Brahmaputra by a Company which has the dubious distinction of its under-construction bridge over river Ganga collapsing like a pack of cards."
