Land Conflict Summary

Thousands of Delhi's Burari residents on November 13, 2023 protested against the demolition orders sent by the government’s Land and Building Department.

Some of the residents claimed that they had purchased the land from local agriculturists and had settled down in the area back in 1985. However, the Delhi High Court in its order to identified them as "encroachers" and directed them to vacate their properties by November 19. Following which, the government sent eviction notices to the residents.

In its order, the court had also warned that “if the property/land is not vacated and handed over within the stipulated time period, the occupants/encroachers will be solely responsible for any damage to the goods lying in said land after the start of demolition."

Over 1,000 families, who have been living on the disputed two acres of land in the Burari area for decades, had appealed against their eviction earlier this year, but the High Court did not grant a stay order. The dispute over the two acres of land started soon after the partition.

In November 2023, writ petitions were filed against the eviction notices issued by the Land and Building Department by 130 Burari residents. The court noted that there are about 5000 households in the area, with more than 20,000 residents. The notices were not served on the petitioners individually but found pasted at various points in the colonies. The Court noted that the entire exercise of the eviction process was illegal and that it cannot be said that the entire colony comprised of encroachers.

On November 17, 2023, the Court issued an interim stay on the eviction notices. The matter is next slated to be heard on February 20, 2024.
